Excerpt from Constitutional Free Speech Defined and Defended in an Unfinished Argument in a Case of Blasphemy From the viewpoint of a deterministic and evolutionary psychology every human action, including judicial decisions, is conditioned upon the past experiences and the present development of individual desires and of mental processes. So then, at some level of understanding, reasons can be found to justify any desire that is dominant. Reasons alone never determine judicial or human action. On the contrary, judicial and human predispositions (desires) quite as certainly determine the choice of rea sons and the relative weight to be given them, as well as the use to which they will be put in formulating judicial action. That our past is ever at work in the present is an established psychologic truth. If its operation is by subconscious processes, then even our judges may be tempted to deny its existence. For the genetic psychologist such denial is to be often expected and proves only that those who make it do not possess the psychologic intelligence necessary for an adequate self-under standing. Many parts of the following discussion are very consciously formulated with the desire to impress this psychologic viewpoint into the service of juridicial evolution.
